2. Products and investments

Risk factors:

  • Smoothing adjustments on our with-profits funds will not be able to counteract the impact of a sustained decline in investment returns.

Important information about property

When there are more people leaving the property fund than investing in it, we may have to sell properties to pay claims. If this is the case, we may take one or other, or both, of the following steps to protect the remaining investors in any fund investing either directly in property or in other funds that are themselves mainly invested in property:

  • When we feel there's a definite trend towards more people selling units in the funds than buying units, we may change our valuation basis to reflect this. This will result in a drop in our fund price. This will be bigger than for other types of funds because of the extra costs involved in buying and selling property when compared with, say, shares.
  • We may also, but not necessarily, delay acting on instructions to switch/cash in a client's investment by anything up to 12 months if market conditions make it difficult for the manager to sell properties at a fair price.

    Other funds that invest in property may have similar provisions.

The value of properties is determined by independent valuers appointed by a fund manager and is generally a matter of their opinion than fact.

11. Data Protection:

(a) Policies issued by AEGON Ireland plc are administered within Ireland, so this administration is subject to Irish laws. The laws that affect the privacy of the personal data for your policyholders are the Data Protection Act 1988 and the Data Protection (Amendment) Act 2003, and any subsequent legislation relating thereto.

(b) The data controller in respect of the personal information provided by you is AEGON Ireland plc.

(c ) If you are based in the United Kingdom, then the personal data that you hold and process will be governed by the Data Protection Act 1998.

(d) AEGON Ireland plc currently operates its security requirements through the Security Policy:

  • Breaches in security are dealt with by the Security Policy.
  • Ensuring that staff treat the data with the respect that it deserves:
    1. All members of staff, including temporary members of staff, sign confidentiality agreements.
    2. Staff are restricted to certain systems which are required in order to carry out their job function.
    3. We ensure that personal information is passed to only those people and organisations that are entitled to know about it. Checks are made to confirm that people are whom they say, and that these organisations or people are allowed to have access to this information. Every business area has their own verification checks that relate to the data held and types of people who may require access.
    4. We train our entire staff in Data Protection and Security. This ensures that members of staff know how to treat personal data and the risks involved if data is poorly treated. Every member of staff needs to complete the Data Protection training every two years.

We have implemented security policies, rules and technical measures to protect the personal data that we have under our control from:

  • unauthorised access
  • improper use or disclosure
  • unauthorised modification
  • unlawful destruction or accidental loss

All our employees and data processors who have access to, and are associated with, the processing of personal data, are obliged to respect the confidentiality of our visitors' personal data.

(e) We will disclose information to certain bodies where we have a legal obligation to do so, for example to regulatory bodies or authorities such as the United Kingdom's Financial Services Authority or HM Revenue & Customs. We may also be required to disclose information in order to comply with money laundering laws and for other purposes, for example detecting crime.
